ELIGIBILITY: The American Chopper Charity Auction is open only to residents of the 50 United States and the District of Columbia, 18 years of age or older at the time of registration (19 years of age or older in AL or NE).

REGISTRATION: To participate in the American Chopper Charity Auction, you must register on the Website (discovery.com/auction) or through the auction application on the American Chopper page on Facebook (www.facebook.com/AmericanChopper). You should only participate if you are willing and able to pay the amount which you bid to buy one of the choppers. No inappropriate usernames will be accepted. Discovery Communications, LLC, the auction administrator ("Discovery"), will check the site for inappropriate usernames and if you attempt to select an inappropriate name, as determined by Discovery, you will receive an error message and be asked to enter another username. Information collected in connection with your registration is subject to Discovery’s privacy policy at: http://www.dsc.discovery.com/utilities/about/privacypolicy.html. This auction is in no way sponsored, endorsed or administered by Facebook. You are providing your information to Sponsor and not to Facebook.

USERNAME AND PASSWORD: Save your username and password in a secure location. Each time you come to the site to participate in the auction, you will be asked to login. If at any time you forget your password, you may gain access to your password by clicking on the "I Forgot My Password" link. Follow the on-screen instructions and your password will be emailed to you. You are responsible for the security of your username and password. All registered auction participants should take precautions to keep their username and password private to prevent unauthorized bidding.

BIDDING: The auction begins on 6/6/2011 at 10:01 PM (ET) and ends on 7/31/2011 at 5:59 PM (ET). The items up for bid are two (2) custom Cadillac Choppers, one designed by Paul Teutel Senior and the other designed by Paul Teutel Junior. The approximate retail value of each chopper is $200,000. Once you have registered and signed in to your account, you will see a description of the items, end date/time for the auction, the official auction clock, and the current highest bid for each item. If you choose to bid on an item, you must enter the dollar amount you wish to bid by clicking on "Place Bid.” The starting bid (minimum bid) will be listed on the page; if bidding has not yet begun, you must bid that amount. If bidding has already begun, you must bid higher than the current high bid by at least $100 in order to have your bid accepted. If your bid is accepted as the new high bid, you will see your username and bid listed on the auction item page as the new high bidder. If you are outbid during the course of the auction, you may continue to bid above the highest bidder. If you are the highest bidder and there are no other bids against you, you cannot bid against yourself to protect your bid - you are only able to bid against other users. Once a bid is placed, it may not be retracted or otherwise canceled for any reason.

END OF AUCTION/WINNER VERIFICATION: The bidding will continue until 5:59 PM (ET) on 7/31/2011, the last day of the auction period for the items. The clock for the Website server is the official clock for this auction. At this time the item page will say, "This Auction is Closed." The person with the highest bid for each item at the close of the auction will be entitled to claim the item, subject to payment of the winning bid and fulfilling all requirements listed in these Terms and Conditions. Payment must be made directly to Discovery. The winning bidder will be required to sign a Liability Release releasing, among others, Discovery Communications, LLC, General Motors, Paul Teutel Sr., Paul Teutel Jr., the Duchenne Muscular Dystrophy Foundation and each of their affiliates, subsidiaries and parents from any liability in connection with the Motorcycles. The winning bidder will receive instructions on how to complete the document. ALL REQUIRED FORMS MUST BE SIGNED IN THE FORM AS PROVIDED AND RECEIVED WITHIN 14 DAYS AND PAYMENT MUST BE SUBMITTED TO DISCOVERY WITHIN 21 DAYS OR THE RIGHT TO THE ITEM WILL BE FORFEITED AND THE ITEM WILL BE OFFERED TO THE NEXT HIGHEST BIDDER.

GENERAL TERMS: Void where prohibited. All federal, state, and local laws and regulations apply. Sales tax on the item and all expenses, including without limitation, shipping costs, related to acceptance and use of the item are the sole responsibility of the auction winners. Acceptance of item constitutes permission to Discovery, Cadillac and each of their agencies to use bidder’s name, image and/or likeness for purposes of advertising and trade without further compensation unless prohibited by law. Bidder acknowledges that the prize items were designed, assembled, and manufactured by Paul Teutel Sr., and Paul Teutel Jr. and General Motors LLC had no involvement in the design, assembly and manufacture of said items. By accepting item, bidder agrees to release and hold Discovery, General Motors, Paul Teutel Sr., Paul Teutel Jr., the Duchenne Muscular Dystrophy Foundation and each of their directors, affiliates, officers, employees and assigns harmless against any and all claims and liability arising out of their participation in the American Chopper Chopper Charity Auction and the acceptance or use of the item. Bidders assume all liability for any injury or damage caused or claimed to be caused, by participation in this auction or use of the item. By participating in this auction, bidders agree to be bound by the terms and conditions of this auction, and that the decisions of Discovery are final. Discovery uses reasonable efforts to include accurate and up to date information regarding the auction items; however, Discovery makes no warranties or representations as to the accuracy of the information. All information regarding the auction items has been provided directly from the manufacturer. Discovery assumes no liability or responsibility for any errors or omissions in the content. Discovery is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of bids, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive information by Discovery on account of technical problems or traffic congestion on the Internet or at any Website or any combination thereof. If for any reason the auction is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Discovery which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this auction, Discovery reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the auction with or without notification to the bidders. WARNING! DISCOVERY RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO SUSPEND OR DELETE YOUR USERNAME AND PASSWORD AT ANY TIME FOR ABUSE OR MISUSE OF THE WEBSITE OR THE BIDDING PROCESS OR FOR NOT COMPLYING WITH THESE OFFICIAL TERMS AND CONDITIONS. Discovery also reserves the right to cancel any bid it believes is not made in good faith. Winning bidders are solely responsible for determining if any portion of the winning bid is deductible and releases Discovery with respect to any claims related thereto. Winners are advised to seek advice from their tax advisor regarding deductibility of any portion of the winning bid.
